Как работать с информацией в условиях неопределенности (из "Мини-энциклопедии созидательного коммуникатора "Переговорщик") 

До тех пор, пока человечество не перейдет к коммуникациям посредством телепатии, главным средством передачи сообщений будет словесная информация, всегда находящаяся в привязке к ее источнику и носителю, а значит, работа с информацией будет занимать большую часть всех забот переговорщика. 

В то время как искусству эффективной работы с информацией учатся до бесконечности, оперируя данными, деловые люди, в первую очередь, заботятся о достоверности, полноте, актуальности, причастности (релевантности), непротивочеривости, а также обоснованности информации (если мы имеем дело с высказываниями, доводами, суждениями). При этом, важно не упускать из внимания, что, работая с информацией, ваш партнер, проверяя имеющуюся у него в распоряжении информацию, тоже будет обеспокоен ее достоверностью, но не исключено, что оба могут добросовестно заблуждаться (например, в случае, когда отчет о работе вашей бригады по договору подряда является неполным, либо когда секретарь не передал руководителю важную переписку и он не владеет всей полнотой информации на текущий момент). Именно поэтому очень важно проверять «картину мира» контрагента на соответствие вашей, и наоборот, допуская, что отличия в оценке всех обстоятельств предмета переговоров могут возникнуть добросовестно, а не по причине чьего-то недоброго умысла. 

Предвосхищению фиаско в деле установления доверия и понимания чаще, чем можно ожидать, способствует также регулярная сверка степени идентичности толкования понятий, которыми оперируют договаривающиеся стороны. Именно по этой причине хороший договор или протокол о намерениях всегда содержит внушительное количество страниц с толкованием понятий, используемых в нижеследующем соглашении, но это вовсе не значит, что они должны быть сложны для восприятия, а совсем наоборот, чем проще и яснее слова, которыми вы пользуетесь, тем яснее, а значит, доверительнее отношения. 

Еще одним аспектом, на который важно обращать внимание при сборе информации, является вопрос компетентности источника информации. Другими словами, прежде чем предпринять какое-либо действие, основываясь на выводах, полученных из внешнего источника (то есть не основанного на личном опыте вывода) обязательно задавайте себе вопрос — «а заслуживает ли этот источник информации доверия?» Если да, то «в какой части или степени?» В нашей капиталистической реальности при работе с публичной информацией необходимо исходить из того, кому принадлежит средство информации, каковы его декларируемые и реальные цели, и на кого работает, какую позицию в иерархии компании занимает, какова его сфера полномочий, если при проверке на компетентность вы работаете с человеком. 

Поскольку существенную долю работы современного парламентера занимают устные переговоры, то помимо изучения формальных законов логики, сформулированных еще Аристотелем, в деле распознавания (осознания) целенаправленной и неумышленной манипуляции критически важно владеть искусством метаязыка (чтения «между строк»). Метаязык, фактически, — средство маскирования истинного смысла информации, которую все же необходимо донести, — очень востребованное политиками, журналистами, юристами и лживыми супругами средство, владение которым является превосходным инструментом для выработки навыка интуитивного распознавания информационных потоков, входящих в поле действия ваших приемников и, наряду с традиционными способами работы с данными, может служить действенной мягкой силой как в установлении дипломатических отношений с родственниками, так и при лоббировании антикоррупционного закона. 

С этой целью стоит учиться понимать значение слов «между строк», обращать особое внимание на контекст употребления некоторых слов-индикаторов манипуляций. Например, слово «надеюсь» — наиболее умный способ скрыть свое мнение, хотя сказанное звучит именно как собственное мнение или слово «кстати», которое всегда указывает на тезис, являющийся на деле основным во всем утверждении. 

Часто весьма ценной является информация, приходящая внезапно (как спонтанная мысль, попавшаяся на глаза заметка или даже сон), но поскольку даже такие случайности не случайны, а результат длительной эволюции вселенной и нашего мозга, как ее части, то и нам следует обеспечить способность мыслить спонтанно и эффективно хорошей предварительной подготовкой. 

Абсолютно достоверно известно, что работа мозга представляет собой фантастически увлекательный и сложный механизм, а так же то, что этот механизм вручен каждому из нас в расчете на продуктивное использование. Пока нейрофизиологи вникают в детали этого бесконечно совершенного механизма, мы, не вдаваясь в биологические подробности, вооружимся волей, хорошим настроением, пользой физических упражнений и попробуем поставить свою центральную нервную систему на службу своему посредническому ремеслу. 

Первое, что пригодится для эффективной работы мозга — это память. Какой бы памятью не обладал человек в силу природных данных, ее можно успешно развивать с помощью хорошо проработанных методик мнемотехники, практики йоги, скорочтения и простого заучивания наизусть. 

В зависимости от направления, в котором хочется продвинуться в области работы памяти можно сконцентрироваться на одном из следующих подходов. 

Так, если вы хотите значительно расширить объем запоминаемой оперативной информации (для публичных выступлений, запоминания услышанного и прочитанного) достаточно разучить наизусть любой текстовый материал того объема, на оперативное запоминание и работу с которым вы рассчитываете. Другими словами, если вы способны выучить наизусть текст закона объемом 10 страниц (а значит в точности воспроизвести его вслух или письменно), следовательно вы способны без напряжения воспринимать, удерживать в сознании и оперировать любой информацией в объеме как минимум 10 страниц. Такая способность тренируется в отношении любого информационного материала — изображение, звук и вообще любые символы — и незаменима в дискуссии, выступлении в суде и совершенствовании навыка по анализу информации. Таким методом «не брезгуют» даже в духовных семинариях, заставляя послушников зазубривать молитвословы на старославянском, древнегреческом, иврите или санскрите. Этим же методом пользовался и завещал всем незабвенный Лев Николаевич Толстой — автор русской идеи непротивления злу насилием. 

Способы развития памяти, основанные на использовании воображения, законов работы мозга и ассоциативного мышления, позволяют научиться хорошо упорядочивать (структурировать), а значит и запоминать разнородную информацию, объединены в направление, условно названное мнемотехника, с помощью которого очень хорошо развивается физиологически обусловленная способность мозга устанавливать нейронные связи, что по сути и есть физическая основа памяти. Пожалуй, одной из самых полезных техник из области мнемотехники, является mind-mapping — схематическая зарисовка содержания текста, с указанием ключевых слов изучаемого материала. Зари- совка обстоятельств дела чернилами разного цвета с пометками о плане действий продвижения в разрешении спора или дела не только облегчает припоминание, но и создает ту самую материализующуюся со временем и вашими небольшими усилиями мыслеобразную картинку. 

Другой качественно смежный и также тренируемый навык мозга — скорочтение. При должном усердии и целеустремленности книга среднего объема (300—400 страниц) может быть прочитана за 30—40 минут без ущерба для понимания. Методика развития навыка скорочтения (по аналогии с навыком езды на велосипеде — приобретенный) в основе своей базируется на одновременном развитии способности мозга (не глаза) охватывать, то есть осознавать, больший объем воспринимаемого текста в единицу времени при одновременном повышении концентрации внимания. На мой взгляд, наиболее проработанными и удобными для адаптации являются методики Тони Бьюзена, а также Олега Андреева. 

Все эти методы работы с информацией могут приносить неоспоримую пользу только в том случае, если уметь и вовремя практиковать полное освобождение от мыслей и расслабление сознания, что оптимальным образом достигается посредством практики йоги (абсолютно славянской по первоначальному происхождению), а лучшая из известных мне дополнительных практик, гармонично интегрируемая в упомянутые техники на сегодняшний день — метод Хосе Сильва (Платона), включающая ежевечернее обратное припоминание своего дня (недели, месяца) на экране воображаемого при закрытых глазах монитора — может сделать любого усердно практикующего переговорщика настоящим гением.

Obviously, any communication situation is unique in a way that the number and quality of combinations of human interactions and its components are unframeable and limitless, - many of which has become challenged under the influence of overall disruption. 

As far as there’s no technology that may provide a gradually sought after, always original communicational solution for constantly variable conditions, - the role of social creativity comes into play. 

Fortunately for the socially aware individuals and conscious leaders, under extreme situations latent conflicts of interests become more transparent naturally, so that some values, paradigms and stereotypes are being reconsidered drastically, therefore allowing great and positive opportunities, emerge from willingness and ability to transform  superficially “negative” situations into commonly beneficial communicational solutions.  

With this idea in mind and with respect to the current situation, Dr. Julia Radanova will host “Creators Negotiate” book presentation in the form of an online, interactive interview with its author Ilya Chernobay. They will walk you through the book's idea, structure and origination, with some coffee breaks in turning points and stories behind them. We will shortly pay due respect to those, who unintentionally  "contributed" to the process the most, then we will recollect a few facts along with outstanding leaders in history, related to the main topic, that worked out as building blocks for the authors' signature negotiating strategy in multilateral mitigation, as well as other universal approaches, that constitute the book itself.

“The power of dedication” in creative economy and why Bulgaria has the best potential to become the world’s center of it.  

When orchestra plays symphony what is happening is that every instrument (meaning performer) in the hall, technically, “agreed” to play predefined (or at least, partly defined) tunes, starting from specific moment with pauses, articulation and dynamic change throughout their performance. They all, in fact, dedicated themselves in doing so, otherwise they would produce nothing, but noise only or simply wouldn’t play at all. 

De facto, at some point and for some good reason, they did prefer to collaborate, which by default, means that orchestra members has some (actually, many, not financial only) shared interests to play. As a result, we have not only pleasant sound to enjoy, but, as a consequence, space in close to music source proximity harmoniously organised, which, as already has been proven, makes water healing, people happier and cows giving milk of better quality. Everything as a unintentional consequence of well arranged sound spreading around, which is in turn intentional consequence of orchestra members pre-agreed performance (collaboration). 

By this exactly analogy in business communications, which organised harmoniously, every team member is a stakeholder of production outcome, “plays” his or her “violin” because of personal temporary dedication in shared with other team members interest to produce that magic, as part of his or her individual mission “matches” with other’s visions for exact period of time in exact piece of space. Just like in orchestra. By this analogy, in natural manner of answering for our inner calls for such kind of activity, we not only allow us to reach unlimited personal fulfilment, but let the very Universe to do their job by providing us with everything needed to make it, as it does in case of the “unintentional” result of water particles having re-shaped themselves in harmonious order, people feeling happier and cows giving milk of better quality. This is how the power of dedication works in practice.

And the most exciting part of the potential for dedicated collaboration lays at the greatness of benefits, that could be gained from so called “spontaneous teaming”, as a result of understanding, that if two or more people physically found themselves next to each other, - it inevitably means, that each of them have something to do together, as a natural outcome of individual’s previously accomplished (consciously or not) thinking, that is, manifestation (due to law of attraction), process. 

Even on micro communicational level, when you come across with someone at seem to be “unnecessary” interaction (which is just a spark, in fact), - we have at least three options on our disposal in situations like that: 

  • To ignore situation (soon to be no longer available due to intensifying global scarcity); 
  • To escalate it to friction (soon to be less available, as a result of increase of interdependence) 
  • To figure out, if there is something, that you (meaning parties or, speaking business, stakeholders involved) have to collaborate on. 

Yes, it takes some sensitivity, irrationality, if you may wish, and selflessness to come to immediately correct solution, but in global situation, which seems steadily heading closer to extremal, we all have no other, then third, options to proceed. 

Therefore, speaking in regards to constructively resolved communication dilemma in business terms, - we may “accidentally” look into gigs, which in legal essence is a project based, temporary contracting, which in fact has been around a very long time, but digital age sharing economy has put freelancers in the spotlight again. 

In this regards. with introduction of the new part-time jobs applications throughout the globe via internet not only did its regulation come into focus, but expanded the range of services people are willing to do independently, which is in general incredibly positive trend. Though it seems clear, that times of completely stateless society are away from now for centuries, it doesn’t mean communities can not self-produce goods and services they actually wants to have by self sourcing these types of production on project collaboration basis, as our wise predecessors actually used to did. 

So far, currently, no matter legal culture and jurisdiction, when it comes to project based collaboration (even simple bilateral one) it is regulated whether by labor law or civil rules. 

Empirically, as any commercial activity by any country’s legal system is considered though the lens of intention of profit creation, which automatically qualify such activity as tax liable, common low jurisdictions globally has already did their “best” in order to not let these trends have a chance to prosper with another regulatory loop. For instance, California Assembly Bill 5 (AB 5), which took effect on Jan. 1, effectively turns freelancers into employees. Any truly independent activity (especially multilateral) at sharing economy, in general, in common law countries seems lacking in legal incentives due to overregulation. 

In the contrast, in Bulgaria, which in fact is boiling with creative and collaborative initiatives (including underground and semi-underground), equipped with proper infrastructure with every day growing number of corners gradually being taken by another private art gallery, co-working space or venue of any kind, - domestic civil legislation about obligations is brilliantly presented by single law statute only - “Obligations and Contracts Act” (OCA). At this point, besides creative market infrastructure, two major aspects makes Bulgaria the most creative economy friendly: 

  1. In practice its government in general seems whether truly liberal or simply doesn’t care too much about what do not involves public financing (and as we remember, liberty is the prerequisite of any creativity)
  2. Articles 22, 23 of OCA directly allow to make a deal in favour of third parties, making independent project activity, dedicated to any community entity legal on one hand and tax on income free - on the other, which in overall yields enormously broad framework for any socially beneficial business in general. 

And what a surprise! This underlooked legal opportunity “accidentally” coincides with the concept of ultimate (third-party) beneficiary concept in collaborative communications, which is described above.

The truth about film 

That is natural for human to make a risk evaluation of the degree of potential aggression from other person in face-to-face interaction, however the same people enjoy tons of emotional rape in movie theatres. Why is that so? It is, perhaps, that we prone to stem from the fact that we are safe, while physically sitting into the middle of concrete box with a friendly interiors, located somewhere in a downtown of somehow developed country. What a nonsense! Psychologist from Prussia, Hugo Munsterberg, was daed right, saying that cinema has unique capacity to reformulate time and space, but who made any positive social outcomes from this?

If we more or less has already figured out what is it all about in general, we, most likely, understand and, hopefully, remember that only real life force is our im-agi-nation. It serve us as endless currency, when we follow our proper life path and obey elementary psychological hygiene. And if so, why should we be surprised, that all radiation we had consumed from video screen (TV, YouTube, Instagram, movie theatre, etc.) not only has interfered our inner vision reproduction process, but even worse, - it damaged it and surrogated it in way, that we no longer follow our vision, but someone else’s instead. How fun is that sound? 

In this case, for those who stood behind the screens, the main task would be to engage us, natural visionaries, at this purely parasite process, which, obviously, has always been accomplished by emotionally provocative scenes. Furthermore, once we experienced emotions of any kind, manifestation process triggers immediately and, since then, we may expect nothing but close the same (in fact primitive part of it) scenario in our real life experience, - whether this is about having another hamburger in highly promoted fast food restaurant, or romantic drama. 

Well, it might not be that terrible if not one only sad (and in fact mortifying) obstacle, - 95 % of all contemporary video content is wether violence or commercial (which is anyway violence, though latent). 

Imagine then, if you still able to, if events, demonstrated at those highly emotional scenes has as much potential for manifestation as many individuals has contributed to it by their “own” vision power. And then imagine, that Mother Nature made in a way, that we all (to different extent, but anyway) connected and therefor, every time you watch video content, you pay your time and money for: 

1. Losing you potential to manifest your own vision; 
2. Let your vision be replaced by someone else’s vision; 
3. "Enjoy" someone else’s scenario, the point of which is mostly manipulation, violence or consumerism. 

Well, please, now imagine something else, because either way, we all may end up with anything, but happy lifetimes.
 

Cross-cultural dimension: Bulgaria (from "Creators negotiate") 

"Apart from any other negotiating culture, although within Eastern European department, stands out Bulgarian communication tradition. As one friend of mine poetically put it, it is easier to make a deal with an alien, than Bulgarian. Well, of course, given that you are dealing with mind reader, it might be challenging, especially, if he or she is infected by low self-esteem complex (which is absolutely groundless), burdened with “the few, the proud, the marines” attitude. I personally can be biased as obligated to Bulgaria some of my happiest times, anyway, in general, I have never met people, that are more kind, wise and talented, as they are. 

Moreover, besides eye-contact, which is predominantly preached by westerners, Bulgarians used to establish heart-contact, so they are able (and prone) to make decisions both on mental and intuitive levels, meaning that, if any of these sensors fail to get their “dobre”, - a deal will most likely not get through, or will be considered as non-grata and, therefore, overpriced. 

Another absolutely astonishing feature of Bulgarian negotiating style is “no “no” policy”, - as I called it. It turned out lately, that the reason for this communication trick is to allow themselves to keep their options open, instead of cutting off potential opportunities by saying direct “no” and turning partner into counter party. Normally, no business decision is made apart from face-to-face conversation. Handshakes with women is a norma and common European “duty”."

Who are the millennials and why they should be strong negotiators?  

First, before jumping into anyhow serious reflection on the topic, it seems crucially essential to start with putting things (meaning words) in order, just like in case of contract drafting we used to  agree on definitions we utilise before structuring (I’d even say constructing) the deal brick by brick. Sorry, word by word. 

So, as it is obviously following from the topic’s title, the main character of the short will be some kind of millennials. And namely, Z-type managers. Sounds curios for me ) 

Generally speaking, millennials are the young generation people, who happened to be massively referred in media as baby boomers’s children, which are now being scrutinised thoroughly as a phenomena (mainly for consumer marketing reasons) and, therefore superficially and vainly. And not only they did become favourite concern for corporations because of their salesman and saleswoman needs, but also due to the reason that those millennials slowly, but surely also become the main labor force, and therefore, human resources, in this regard, seems decided to lean themselves all upon the same shoulder. And by no means last-named wouldn’t have it any other way. Hope, for the good. Is it, really? 

The most insightful among this story’s main character representatives figured out their incompatibility with corporate world fast, while bravest ones went further and stepped out of it forever for the reason that corporate world prefer to vail - some of those millennials are not harmonious piece of corporate strategy and customer research report, - they are agents of change, they are z-type managers. And nothing might compensate the pain of losing one’s own lifetime in exchange of fake sense of comfort and sustainability. 

At the happy (and never really coming to it) end of this story, its heroes have all become real life rock stars, called entrepreneurs (also known as former freelancers) whatever their creativity outcome is. And guess who’s “clients” they become at the end of the day? No ones. However many times we can hear that endless number of institutions talking about them, - in charmless reality they don’t give a shit, and this fact could be explained technically: you can’t care about the one who is better (smarter, more fearless, empathetic, ethical, has more stamina, because have no choice to not have) then you, even if your name is government, bank, employer, college or venture capital fund (with few exceptions). With so few exceptions, that fairly could be neglected. 

This is who millennials are in fact (in a nutshell). 

In any country. 

Any time. 

Well, there was another question in this story's title. 

Should I really further waste electricity justifying obviousness? 

I don’t think so.

We are happy to announce the launch of the kolobog.com platform development process. It took quite a while to connect dots together and finally start working on the project production. 

Future ICT platform is designated to serve millennials with collaborative contracting system in order to mitigate their main challenges: job satisfaction and independence. It focuses on from grass roots ideas and aims to disrupt corporate world. 

Platform's mechanism works exactly as 5-dimensions Universe does: once you become obsessed with good idea, you are provided with right people and resources, which are necessary and sufficient enough in order to make it happen right immediately. The platform will display only real-time actual information, engage likeminded people in agile-like real-live off line collaborations on sites, whichever comfortable to them (primarily libraries, co-working spaces and coffee shops).

Intentionally uncomfortable in Hamburg  


Hamburg appeared to be the stormy place. And it winds mind with songs, which has its own pretty dramatic story. Given that Artisan song has several tempo changes, at first, it was not recommended for production due to its specific. Written and partly recorded in Hamburg it has happened to be finally mixed and mastered in Rostov-on-Don much later, where the first harmonic idea had also came to mind previously. The piece itself intentionally sounds clumsy as it is musical dedication to independent emerging creators and freelancers of all sorts and kinds.
